Alternative dispute resolution is, as a rule, a faster, simpler and less burdensome way for customers and credit servicers to settle their disputes without the need to go to court.
An alternative dispute resolution body acts as an impartial third party between the debtor and the credit servicer. This body may:
Credit servicers authorised to carry out this activity in Portugal and other entities authorised to provide credit servicing activities are obliged to offer effective and adequate out-of-court dispute resolution procedures.
For that purpose, they must adhere to at least two alternative dispute resolution bodies that are part of the consumer arbitration network, disclosed on the Consumer Website (in Portuguese only).
Disputes relating to debtors’ rights and to the obligations of credit servicers (provided for in the scheme approved by Decree-Law No 103/2025) (in Portuguese only), regardless of the value of the dispute, are covered by this scheme.
